Terms of Service

Terms of Service

Last updated: August 2026

1. General provisions

1.1. These Terms of Service (the "Terms" or "Offer") govern the relationship between Andrii Syrovoiskyi, an independent developer operating under the commercial brand ⚡ ThunderWeb ("Contractor"), and any individual or legal entity ("Client") ordering website development and analytics setup services on thunderwebs.com (the "Site"). 1.2. The Client accepts this Offer by performing any of the following actions: submitting the request form on the Site, sending a project brief via the Contractor's messengers/email, or making a payment for the services. 1.3. The current version of the Terms is always available at thunderwebs.com/terms. The Contractor reserves the right to amend the Terms without prior individual notice to the Client.

2. Scope and delivery of services

2.1. The Contractor provides website planning, web design, and front-end/back-end development services (built on Next.js, Tailwind CSS, Cloudflare, and similar stacks), as well as web analytics integration (Google Analytics 4, Consent Mode v2, Meta Pixel/CAPI). 2.2. Workflow and preview demo: — Development begins once the brief is completed and the scope of work is agreed. — The Contractor builds the base version of the project (up to 75% of the total scope) and gives the Client an interactive preview link (a demo hosted on the Contractor's test domain). — The Client reviews the preview against the agreed brief. 2.3. Moving the site to the Client's domain and server, transferring the source code, and the final transfer of project rights take place strictly after the agreed fee has been paid in full. 2.4. Freezing and acceptance in the absence of feedback: if the Client does not provide feedback, revisions, or materials needed to continue the work within 10 calendar days of the preview or a request being sent by the Contractor, the project is deemed accepted by the Client as-is, without objections, and the Contractor's obligations are deemed fully performed. Resuming work on a frozen project after 10 days of silence is subject to the parties' agreement.

3. Fees and payment terms

3.1. The cost of services is based on the Contractor's current rates published on the Site, or is fixed in an individual commercial proposal. 3.2. All payments are made by non-cash transfer — bank transfer (IBAN/SEPA) or electronic payment systems (Stripe / Revolut Business / PayPal). 3.3. Delivery process: moving the site to the Client's domain and hosting, transferring the source code, and granting administrative access take place strictly after 100% of the agreed payment has actually been received in the Contractor's account. 3.4. Refund policy: — If, at the preview (demo) stage, the Client decides not to continue the project because it does not match the brief, the Client is not obligated to pay the remaining balance. — Once the source code has been transferred, the site has been moved to the Client's domain, or administrative access has been granted, the services rendered are deemed fully accepted and the full fee becomes payable. No refunds are issued after the source code has been transferred.

4. Intellectual property

4.1. All source materials, design mockups, program code, and scripts created by the Contractor in the course of the work remain the Contractor's exclusive property until the Client has paid for the services in full. 4.2. Once payment has been received in full, the Contractor grants the Client a non-exclusive right to use the resulting website and its code for the Client's commercial and personal purposes. 4.3. The Client grants the Contractor the right to publish screenshots, interactive demos, and a description of the completed project in the portfolio on thunderwebs.com and on the Contractor's social media (unless the parties have signed a separate non-disclosure agreement — NDA).

5. Client's rights and obligations. Content

5.1. The Client agrees to provide, in a timely manner, the text, graphic, and advertising materials needed to populate the site, as well as any required technical access (domain registrar, ad accounts). 5.2. The Client bears full and sole responsibility for: — The legality, accuracy, and copyright of the text and visual materials provided to the Contractor for publication on the site. — Compliance with the local laws of the country where the business operates (including consumer protection and trade laws, and GDPR requirements in the EU). — Ensuring the completed site carries the licenses, certificates, and policies required for the goods or services the Client sells. 5.3. The Contractor is not liable for third-party claims or penalties imposed by EU regulators arising from the Client's content or business activities.

6. Limitation of liability and warranty

6.1. Warranty period: the Contractor provides a free 14-calendar-day warranty from the date the site is delivered, to fix any software bugs identified, provided they are the Contractor's fault and are not caused by the Client or third parties modifying the source code. 6.2. The Contractor is not liable for: — Site disruptions caused by failures on the side of third-party services (hosting providers, domain registrars, Cloudflare, Vercel, Meta API, Google Services). — The suspension of the Client's ad accounts on Meta Ads, Google Ads, or other platforms (the Contractor guarantees the correct technical delivery of signals/pixels but is not responsible for ad networks' moderation of the Client's content). — Changes to the site's code or settings made by the Client or third-party specialists after the project has been delivered.

7. Governing law and dispute resolution

7.1. These Terms are governed by and construed in accordance with the laws of Ireland and applicable European Union regulations. 7.2. The parties shall resolve all disputes and disagreements through negotiation. The response period for a claim is 14 business days. If no agreement can be reached, the dispute shall be resolved in the courts having jurisdiction over the Contractor's place of business.
